9TH MARKET PLACE operates an anti-fraud, anti-terrorism financing and anti-money laundering compliance program and reserves the right to perform due diligence checks on all users of the 9th market place. THE EXISTENCE OF MORE THAN ONE CLAIM WILL NOT ENLARGE THIS LIMIT. YOU AGREE THAT OUR SERVICE PROVIDERS WILL HAVE NO LIABILITY OF ANY KIND ARISING FROM OR RELATING TO THIS AGREEMENT.

DISPUTE RESOLUTION (ARBITRATION CLAUSE AND CLASS ACTION WAIVER)

YOU AGREE THAT BY ENTERING INTO THIS AGREEMENT, YOU AND 9TH MARKET PLACE ARE EACH WAIVING THE RIGHT TO TRIAL BY A COURT OR TO PARTICIPATE IN A CLASS ACTION. YOU AND 9TH MARKET PLACE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. ANY ARBITRATION WILL TAKE PLACE ON AN INDIVIDUAL BASIS; CLASS ARBITRATIONS AND CLASS ACTIONS ARE NOT PERMITTED.

NO WAIVER

No failure or delay by 9TH MARKET PLACE in exercising any right, power or privilege under this Agreement will operate as a waiver thereof, nor will any single or partial exercise of any right, power or privilege preclude any other or further exercise thereof or the exercise of any other right, power, or privilege under this Agreement.
